員工私下換班期間遭遇車(che)禍,算工傷嗎?
近日,河南省高(gao)級人(ren)民法院公布(bu)的一起案(an)例引發關注。

法院判決:屬于工傷
據(ju)河(he)南(nan)省高級人民(min)法院,某清潔公(gong)司員工劉某和楊某駕駛同一(yi)輛機掃車負責某路段衛生,按公(gong)司要求(qiu)二人輪替(ti)各半天上班。
一天劉(liu)某(mou)與(yu)楊某(mou)私(si)下(xia)協商(shang)換班,劉(liu)某(mou)騎電(dian)動(dong)車上班路上與(yu)一轎(jiao)車發生碰撞,劉某受傷、兩(liang)車損壞,轎車司機負全責(ze)。當地社保局認定劉(liu)某屬(shu)工(gong)傷,公司認為(wei)劉(liu)某私(si)下換班違規,不應認定工(gong)傷,遂將社保局訴至法院。
周口市川匯區法(fa)院經審理(li)認為:
《工傷保險條例》第十四條第六項規定“職工在上下班途中受到非本人主要責任的交通事故或者城市軌道交通、客運輪渡、火車事故傷害的應當認定為工傷”,本案中劉某系公司聘用職工,劉某和楊某均駕駛同一輛機掃車負責清掃公司指定路段衛生,且均以完成當天工作任務作為考核指標。二人雖未按照公司規定的時間上下班,但二人私下協商輪流上班的替換班方式,是以完成公司指派任務為前提的。在實際工作運行(xing)中(zhong)公司(si)也未明確分(fen)配二人工作時間,類似替換班情(qing)況經常發生,公司(si)也未予以阻(zu)止(zhi),應視為默(mo)認了換班行(xing)為。
劉某發生事故(gu)地點位于家與單位之間,在合理的上班路線上,事故(gu)時(shi)間也屬于正(zheng)常的上班時(shi)間。人社局作出工傷(shang)認定(ding)事實(shi)清(qing)(qing)楚,適用法律正(zheng)確,法院判決駁回清(qing)(qing)潔公司的訴訟請求,二審維持原判。

法(fa)官(guan)提醒(xing):勞(lao)動者應注(zhu)意加強自身防護,學法懂法守法,如遇到人身傷害,依法維護自身合(he)法權(quan)益(yi)。

10個工傷認定案件裁判規則
工傷(shang)認定案(an)件裁判規則第1條(tiao):
職工違反用人單位(wei)(wei)內(nei)部規定在下班(ban)途中受到機(ji)動(dong)車傷(shang)(shang)害的,該事(shi)故(gu)傷(shang)(shang)害如符合工傷(shang)(shang)保險條例規定的情(qing)形,應當(dang)認定為工傷(shang)(shang),但對用人單位(wei)(wei)利益造成(cheng)較(jiao)大損失的除外。
【規則描述】職工(gong)違(wei)(wei)反(fan)用(yong)人單位內部規(gui)(gui)(gui)定(ding)(ding)下班,在途(tu)中受到(dao)(dao)非本人主要責(ze)任的交(jiao)通事故或者(zhe)(zhe)城市軌道交(jiao)通、客(ke)運(yun)輪(lun)渡、火車(che)事故傷(shang)(shang)(shang)害的,如果“下班途(tu)中”工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)的其他要件(jian)均滿足,應認(ren)(ren)定(ding)(ding)為工(gong)傷(shang)(shang)(shang)。但是,從利益衡平角度出發,應對職工(gong)違(wei)(wei)反(fan)用(yong)人單位內部規(gui)(gui)(gui)定(ding)(ding)的程度加(jia)以合理限定(ding)(ding)。如果職工(gong)嚴重違(wei)(wei)反(fan)用(yong)人單位內部規(gui)(gui)(gui)定(ding)(ding),對用(yong)人單位工(gong)作秩(zhi)序造成重大不良影響(xiang)或者(zhe)(zhe)給用(yong)人單位造成較大經濟(ji)損失(shi)時,其在非正(zheng)常下班途(tu)中受到(dao)(dao)機動車(che)傷(shang)(shang)(shang)害的,不宜認(ren)(ren)定(ding)(ding)為工(gong)傷(shang)(shang)(shang)。
工傷認定(ding)案件裁判規則(ze)第(di)2條:
當事人僅以社會保(bao)險行(xing)政部門作(zuo)出工傷認定(ding)結論超過(guo)規定(ding)期限為由(you)訴請撤銷,若(ruo)沒有其他依法應(ying)予撤銷情形的(de),不予支持。
【規則描(miao)述(shu)】現行(xing)(xing)工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)相關法(fa)(fa)(fa)律規(gui)范中(zhong)對社會(hui)保(bao)險行(xing)(xing)政部(bu)(bu)(bu)門(men)(men)作出工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)結論(lun)(lun)的期限(xian)(xian)規(gui)定(ding)得較(jiao)(jiao)為籠統。實(shi)踐中(zhong),社會(hui)保(bao)險行(xing)(xing)政部(bu)(bu)(bu)門(men)(men)由于等(deng)(deng)(deng)待勞動關系(xi)仲裁、訴訟(song)結果、職業病或(huo)傷(shang)(shang)(shang)情(qing)鑒定(ding)等(deng)(deng)(deng)結論(lun)(lun),申請(qing)(qing)人(ren)補充證明材料以及其他調(diao)查需(xu)要(yao)等(deng)(deng)(deng)原因,超(chao)過60日的規(gui)定(ding)期限(xian)(xian)作出工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)結論(lun)(lun)的情(qing)況較(jiao)(jiao)為常見,但《工(gong)傷(shang)(shang)(shang)保(bao)險條(tiao)例》和(he)《工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)辦法(fa)(fa)(fa)》對因正當(dang)事由耽誤期限(xian)(xian)僅(jin)作出了中(zhong)止規(gui)定(ding),沒(mei)有(you)延長(chang)、扣除(chu)的規(gui)定(ding),且列(lie)舉的情(qing)形(xing)(xing)較(jiao)(jiao)為單一。在(zai)此(ci)情(qing)況下,如工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)結論(lun)(lun)不存(cun)在(zai)《行(xing)(xing)政訴訟(song)法(fa)(fa)(fa)》第七(qi)十(shi)條(tiao)規(gui)定(ding)的依(yi)法(fa)(fa)(fa)應予撤(che)銷情(qing)形(xing)(xing),當(dang)事人(ren)僅(jin)以社會(hui)保(bao)險行(xing)(xing)政部(bu)(bu)(bu)門(men)(men)超(chao)過規(gui)定(ding)期限(xian)(xian)作出工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)結論(lun)(lun)違(wei)反(fan)法(fa)(fa)(fa)定(ding)程序為由訴請(qing)(qing)撤(che)銷,不應予以支持。
工傷認(ren)定(ding)案(an)件裁判規則第3條:
職(zhi)工因參(can)加(jia)用人(ren)單位(wei)組織或指(zhi)定(ding)參(can)與的(de)文體活動(dong)受傷,如無證據證明活動(dong)非受指(zhi)派不得參(can)與,用人(ren)單位(wei)以(yi)職(zhi)工自愿參(can)加(jia)為由主張(zhang)不應認定(ding)工傷的(de),不予支持。
【規則(ze)描述】用(yong)人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)或企(qi)業組織各類(lei)文化娛樂(le)、體育(yu)競技等活(huo)(huo)動主(zhu)要目(mu)的(de)(de)(de)是實現單(dan)(dan)(dan)位(wei)(wei)或企(qi)業利(li)(li)益,其基本態度(du)應是鼓(gu)勵(li)或積極要求職(zhi)工(gong)參(can)(can)與(yu)(yu),雖然職(zhi)工(gong)因(yin)參(can)(can)與(yu)(yu)活(huo)(huo)動也獲得(de)了(le)休閑放松或物質、精神獎(jiang)勵(li)等客觀利(li)(li)益,但仍(reng)不(bu)(bu)影響“最大利(li)(li)益歸于單(dan)(dan)(dan)位(wei)(wei)”的(de)(de)(de)認定(ding)。國務院法(fa)制辦(ban)、最高(gao)人(ren)(ren)(ren)民(min)(min)法(fa)院均已將用(yong)人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)組織的(de)(de)(de)此(ci)類(lei)活(huo)(huo)動明(ming)確(que)為工(gong)作安排(pai),故此(ci),在參(can)(can)加(jia)用(yong)人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)組織或由用(yong)人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)指定(ding)參(can)(can)與(yu)(yu)的(de)(de)(de)文體活(huo)(huo)動中受傷(shang),除有證據證明(ming)活(huo)(huo)動存在非經單(dan)(dan)(dan)位(wei)(wei)指派、選拔等程序(xu)不(bu)(bu)得(de)參(can)(can)與(yu)(yu)的(de)(de)(de)限(xian)定(ding),用(yong)人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)以職(zhi)工(gong)系自(zi)愿參(can)(can)加(jia)活(huo)(huo)動、不(bu)(bu)應認定(ding)為工(gong)傷(shang)抗辯(bian)的(de)(de)(de),人(ren)(ren)(ren)民(min)(min)法(fa)院不(bu)(bu)予采納。
工(gong)傷認定案件裁判規則第4條:
社會保險行政部門對(dui)工傷認定申請應當采用(yong)形式審查(cha)(cha)標準(zhun),進行實質審查(cha)(cha)作出行政決定的,不予支持。
【規則描述】工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)包括申(shen)(shen)請(qing)(qing)(qing)、受(shou)理(li)、用人單(dan)位舉證(zheng)、調查(cha)(cha)(cha)核(he)實、認(ren)(ren)定(ding)(ding)等多個階段(duan),在(zai)程序性(xing)的申(shen)(shen)請(qing)(qing)(qing)、受(shou)理(li)階段(duan),社會保(bao)險行(xing)(xing)政(zheng)部門對申(shen)(shen)請(qing)(qing)(qing)材(cai)料(liao)(liao)的審(shen)查(cha)(cha)(cha)應當(dang)為(wei)形式(shi)審(shen)查(cha)(cha)(cha),不能(neng)過度進(jin)行(xing)(xing)實質審(shen)查(cha)(cha)(cha)。根據《工(gong)傷(shang)(shang)(shang)保(bao)險條(tiao)例(li)》第十八條(tiao)的規定(ding)(ding),申(shen)(shen)請(qing)(qing)(qing)人提出工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)(shen)請(qing)(qing)(qing)應當(dang)提交(jiao)與用人單(dan)位存在(zai)勞(lao)動(dong)(dong)關(guan)系(包括事實勞(lao)動(dong)(dong)關(guan)系)的證(zheng)明(ming)材(cai)料(liao)(liao)。在(zai)工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)(shen)請(qing)(qing)(qing)中,申(shen)(shen)請(qing)(qing)(qing)人承擔著存在(zai)勞(lao)動(dong)(dong)關(guan)系和(he)因工(gong)受(shou)到傷(shang)(shang)(shang)害(hai)的初(chu)(chu)步(bu)證(zheng)明(ming)責(ze)任。因此(ci),對工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)(shen)請(qing)(qing)(qing)的形式(shi)審(shen)查(cha)(cha)(cha)并非簡單(dan)的申(shen)(shen)請(qing)(qing)(qing)資(zi)(zi)料(liao)(liao)是(shi)否完備的審(shen)查(cha)(cha)(cha),社會保(bao)險行(xing)(xing)政(zheng)部門需對申(shen)(shen)請(qing)(qing)(qing)資(zi)(zi)料(liao)(liao)是(shi)否達(da)到符合(he)工(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)(shen)請(qing)(qing)(qing)條(tiao)件的證(zheng)明(ming)程度,主要是(shi)勞(lao)動(dong)(dong)關(guan)系證(zheng)明(ming)材(cai)料(liao)(liao)是(shi)否達(da)到初(chu)(chu)步(bu)證(zheng)明(ming)力,進(jin)行(xing)(xing)合(he)理(li)、審(shen)慎地審(shen)查(cha)(cha)(cha)核(he)實。
工(gong)傷認定(ding)案件裁判規則第5條:
村民委員會與對外聘用(yong)人員的用(yong)工(gong)關(guan)系符合勞(lao)動關(guan)系特征,聘用(yong)人員因履行工(gong)作職責受(shou)到傷害(hai)的,應當(dang)認定(ding)為工(gong)傷。
【規則描述】村民(min)(min)(min)(min)委員(yuan)(yuan)會系(xi)村民(min)(min)(min)(min)自(zi)我管理、自(zi)我教育、自(zi)我服務的(de)基層群眾性自(zi)治(zhi)(zhi)組(zu)織。根據《民(min)(min)(min)(min)法典》第一百零一條的(de)規定,村民(min)(min)(min)(min)委員(yuan)(yuan)會具(ju)有(you)基層群眾性自(zi)治(zhi)(zhi)組(zu)織法人資格,可以從事(shi)為履行職能所(suo)需要(yao)的(de)民(min)(min)(min)(min)事(shi)活(huo)動。村民(min)(min)(min)(min)委員(yuan)(yuan)會招聘(pin)外(wai)部工作人員(yuan)(yuan)從事(shi)勞(lao)動,其與聘(pin)用(yong)人員(yuan)(yuan)的(de)用(yong)工關系(xi)符(fu)合(he)《勞(lao)動法》和《勞(lao)動合(he)同法》規定的(de)形(xing)式及(ji)實質要(yao)件的(de),二者之間(jian)形(xing)成(cheng)勞(lao)動關系(xi),聘(pin)用(yong)人員(yuan)(yuan)在工作時間(jian)、工作場所(suo)內因(yin)工作原因(yin)受到傷害的(de),應當認定為工傷。
工傷認定案件裁(cai)判(pan)規則第6條:
職工(gong)醉酒與自(zi)身傷亡事故之間不存在(zai)因(yin)果關系,且職工(gong)所受(shou)傷害(hai)符合認定工(gong)傷或者視同工(gong)傷法定情形(xing),社會保險行政部門僅以(yi)醉酒為由排(pai)除工(gong)傷認定的,不予支持。
【規則描述】根據(ju)《工(gong)(gong)傷(shang)(shang)保(bao)險條例(li)》第十六(liu)條的(de)(de)規定(ding)(ding)(ding),醉酒(jiu)(jiu)系(xi)職(zhi)(zhi)工(gong)(gong)受(shou)到的(de)(de)傷(shang)(shang)害符合認(ren)(ren)定(ding)(ding)(ding)工(gong)(gong)傷(shang)(shang)或者(zhe)視同工(gong)(gong)傷(shang)(shang)的(de)(de)排除性情形(xing)。雖然本規定(ding)(ding)(ding)未明確醉酒(jiu)(jiu)等不得(de)認(ren)(ren)定(ding)(ding)(ding)為工(gong)(gong)傷(shang)(shang)或者(zhe)視同工(gong)(gong)傷(shang)(shang)的(de)(de)情形(xing)需要和職(zhi)(zhi)工(gong)(gong)所受(shou)傷(shang)(shang)害存(cun)在(zai)因果關系(xi),但是(shi)基于(yu)保(bao)障(zhang)因工(gong)(gong)作遭受(shou)事(shi)故(gu)傷(shang)(shang)害或者(zhe)患職(zhi)(zhi)業(ye)病的(de)(de)職(zhi)(zhi)工(gong)(gong)獲得(de)醫(yi)療救治和經濟補償的(de)(de)考量,在(zai)工(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)過(guo)程中,應當考慮傷(shang)(shang)亡是(shi)否(fou)與醉酒(jiu)(jiu)存(cun)在(zai)因果關系(xi),不存(cun)在(zai)因果關系(xi)的(de)(de),則不能機械地適(shi)用第十六(liu)條規定(ding)(ding)(ding),單純以醉酒(jiu)(jiu)為由不予認(ren)(ren)定(ding)(ding)(ding)工(gong)(gong)傷(shang)(shang)。
工傷認定案(an)件裁判(pan)規則(ze)第7條:
職工在用人單(dan)位要求(qiu)或鼓(gu)勵參加(jia)的單(dan)位組織的活動中受傷,應當視為(wei)工作原因,但參加(jia)與工作無關(guan)的活動除外
【規(gui)則(ze)描述】職(zhi)(zhi)工(gong)(gong)在參加(jia)單(dan)(dan)位組(zu)織的(de)(de)(de)活(huo)動(dong)中受傷(shang)(shang)(shang)能否認(ren)定(ding)為(wei)工(gong)(gong)傷(shang)(shang)(shang),核心要素是工(gong)(gong)作(zuo)(zuo)原(yuan)因。《審理工(gong)(gong)傷(shang)(shang)(shang)保險行(xing)政(zheng)案件規定(ding)》第(di)四條第(di)二項和《工(gong)(gong)傷(shang)(shang)(shang)保險條例若干問題意(yi)見(二)》第(di)四條,明(ming)確了職(zhi)(zhi)工(gong)(gong)在參加(jia)用人單(dan)(dan)位組(zu)織或(huo)受用人單(dan)(dan)位指派參加(jia)的(de)(de)(de)活(huo)動(dong)中受傷(shang)(shang)(shang),應(ying)(ying)當視為(wei)工(gong)(gong)作(zuo)(zuo)原(yuan)因,并把參加(jia)與工(gong)(gong)作(zuo)(zuo)無關的(de)(de)(de)活(huo)動(dong)作(zuo)(zuo)為(wei)阻(zu)卻事由。為(wei)了更好地(di)保護職(zhi)(zhi)工(gong)(gong)權益,除了用人單(dan)(dan)位要求職(zhi)(zhi)工(gong)(gong)參加(jia)單(dan)(dan)位組(zu)織的(de)(de)(de)活(huo)動(dong)外,職(zhi)(zhi)工(gong)(gong)在單(dan)(dan)位鼓(gu)勵職(zhi)(zhi)工(gong)(gong)參加(jia)的(de)(de)(de)單(dan)(dan)位組(zu)織的(de)(de)(de)活(huo)動(dong)中受傷(shang)(shang)(shang),也應(ying)(ying)視為(wei)工(gong)(gong)作(zuo)(zuo)原(yuan)因。
工傷(shang)認定案件裁(cai)判規則第8條(tiao):
職工在家加班,突(tu)發(fa)疾病死(si)亡或者(zhe)在48小時之內(nei)經(jing)搶救(jiu)無(wu)效死(si)亡的,應當認(ren)定為工傷。
【規則描述】職工(gong)(gong)(gong)為了單位的利益在(zai)家(jia)(jia)加(jia)班,是職工(gong)(gong)(gong)工(gong)(gong)(gong)作(zuo)的延伸,應(ying)當屬(shu)于“工(gong)(gong)(gong)作(zuo)時(shi)(shi)間(jian)(jian)和工(gong)(gong)(gong)作(zuo)崗位”,根據《工(gong)(gong)(gong)傷(shang)保險條例》第(di)十五條第(di)一項視(shi)同工(gong)(gong)(gong)傷(shang)的規定,在(zai)家(jia)(jia)加(jia)班期間(jian)(jian)突發疾病(bing)死亡(wang)或者在(zai)48小時(shi)(shi)內經搶救無效死亡(wang),應(ying)認定為工(gong)(gong)(gong)傷(shang)。人(ren)民法院在(zai)對(dui)這類案件進行審理時(shi)(shi),需要(yao)著重(zhong)審查突發疾病(bing)與(yu)加(jia)班工(gong)(gong)(gong)作(zuo)之(zhi)間(jian)(jian)是否具有(you)一定的關聯性(xing)。
工傷認定案件(jian)裁判(pan)規(gui)則第9條:
職工因工外出,在履行工作職責(ze)(ze)過程中發(fa)生交通事(shi)(shi)故的(de),即使(shi)負事(shi)(shi)故主要責(ze)(ze)任或全部責(ze)(ze)任,也應當認定為工傷。
【規則(ze)描述】《工(gong)(gong)(gong)傷(shang)保(bao)險條(tiao)例》第十四(si)條(tiao)第五項(xiang)規定(ding),因工(gong)(gong)(gong)外(wai)(wai)出(chu)期(qi)間(jian),由(you)于工(gong)(gong)(gong)作(zuo)原(yuan)因受到傷(shang)害(hai)或者發生事(shi)故下落(luo)不(bu)明的,應認定(ding)為(wei)工(gong)(gong)(gong)傷(shang)。該條(tiao)款并(bing)未對(dui)職(zhi)(zhi)工(gong)(gong)(gong)受傷(shang)害(hai)的過(guo)錯程(cheng)度(du)與責任進行劃分,這與《工(gong)(gong)(gong)傷(shang)保(bao)險條(tiao)例》第十四(si)條(tiao)第六項(xiang)職(zhi)(zhi)工(gong)(gong)(gong)不(bu)負主要責任才(cai)認定(ding)為(wei)工(gong)(gong)(gong)傷(shang)有(you)著(zhu)本質區別。在(zai)(zai)司(si)法(fa)實踐中(zhong)(zhong)(zhong),對(dui)因工(gong)(gong)(gong)外(wai)(wai)出(chu)途(tu)中(zhong)(zhong)(zhong)與上下班途(tu)中(zhong)(zhong)(zhong)的區分關鍵(jian)在(zai)(zai)于職(zhi)(zhi)工(gong)(gong)(gong)是否(fou)仍(reng)在(zai)(zai)履行工(gong)(gong)(gong)作(zuo)職(zhi)(zhi)責,其中(zhong)(zhong)(zhong)包括出(chu)發去外(wai)(wai)地的途(tu)中(zhong)(zhong)(zhong)到完成工(gong)(gong)(gong)作(zuo)返(fan)回單位的全部期(qi)間(jian),在(zai)(zai)這期(qi)間(jian)內排除因職(zhi)(zhi)工(gong)(gong)(gong)個人活(huo)動受到傷(shang)害(hai)的阻卻事(shi)由(you)外(wai)(wai),受到的傷(shang)害(hai)均應認定(ding)為(wei)工(gong)(gong)(gong)傷(shang)。
工(gong)傷認(ren)定案件裁判規則(ze)第10條:
超過法定退(tui)休年齡未享受養(yang)老保險待遇或未領(ling)取退(tui)休金的勞動(dong)者因(yin)工受傷(shang)的,可以認定為工傷(shang)。
【規則(ze)描述(shu)】法(fa)(fa)定(ding)(ding)(ding)(ding)(ding)退(tui)(tui)(tui)休(xiu)年齡制(zhi)度設計的(de)初(chu)衷(zhong)是(shi)保護勞(lao)動(dong)(dong)者(zhe)權(quan)益(yi),故(gu)不可(ke)成(cheng)為剝奪勞(lao)動(dong)(dong)者(zhe)勞(lao)動(dong)(dong)權(quan)利的(de)借(jie)口,更(geng)不能(neng)成(cheng)為排除工(gong)(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)的(de)法(fa)(fa)定(ding)(ding)(ding)(ding)(ding)事(shi)由。《離(li)退(tui)(tui)(tui)休(xiu)人員(yuan)(yuan)與(yu)現工(gong)(gong)(gong)(gong)作(zuo)(zuo)單(dan)位(wei)之間是(shi)否(fou)構成(cheng)勞(lao)動(dong)(dong)關(guan)系以及工(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)間內(nei)受(shou)傷(shang)(shang)是(shi)否(fou)適(shi)用(yong)工(gong)(gong)(gong)(gong)傷(shang)(shang)保險(xian)條例(li)問題答復》明確(que)了受(shou)聘于現工(gong)(gong)(gong)(gong)作(zuo)(zuo)單(dan)位(wei)離(li)退(tui)(tui)(tui)休(xiu)人員(yuan)(yuan)應(ying)當(dang)適(shi)用(yong)《工(gong)(gong)(gong)(gong)傷(shang)(shang)保險(xian)條例(li)》的(de)有關(guan)規(gui)定(ding)(ding)(ding)(ding)(ding)處(chu)理。《超過法(fa)(fa)定(ding)(ding)(ding)(ding)(ding)退(tui)(tui)(tui)休(xiu)年齡的(de)務工(gong)(gong)(gong)(gong)農(nong)民因(yin)(yin)工(gong)(gong)(gong)(gong)傷(shang)(shang)亡(wang)適(shi)用(yong)工(gong)(gong)(gong)(gong)傷(shang)(shang)保險(xian)條例(li)答復》中(zhong)已(yi)(yi)經明確(que)用(yong)人單(dan)位(wei)聘用(yong)的(de)超過法(fa)(fa)定(ding)(ding)(ding)(ding)(ding)退(tui)(tui)(tui)休(xiu)年齡的(de)務工(gong)(gong)(gong)(gong)農(nong)民,在工(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)間內(nei),因(yin)(yin)工(gong)(gong)(gong)(gong)作(zuo)(zuo)原因(yin)(yin)傷(shang)(shang)亡(wang)的(de),應(ying)當(dang)適(shi)用(yong)《工(gong)(gong)(gong)(gong)傷(shang)(shang)保險(xian)條例(li)》的(de)有關(guan)規(gui)定(ding)(ding)(ding)(ding)(ding)進行工(gong)(gong)(gong)(gong)傷(shang)(shang)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)。因(yin)(yin)此,無論是(shi)退(tui)(tui)(tui)休(xiu)返聘人員(yuan)(yuan),還是(shi)超法(fa)(fa)定(ding)(ding)(ding)(ding)(ding)退(tui)(tui)(tui)休(xiu)年齡的(de)務工(gong)(gong)(gong)(gong)農(nong)民工(gong)(gong)(gong)(gong),在其未享受(shou)養老保險(xian)待遇(yu)或領取退(tui)(tui)(tui)休(xiu)金的(de)前提下,在工(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)間、工(gong)(gong)(gong)(gong)作(zuo)(zuo)地點因(yin)(yin)工(gong)(gong)(gong)(gong)作(zuo)(zuo)原因(yin)(yin)發生事(shi)故(gu)可(ke)以認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)為工(gong)(gong)(gong)(gong)傷(shang)(shang)。另外,對(dui)于已(yi)(yi)經參與(yu)工(gong)(gong)(gong)(gong)傷(shang)(shang)保險(xian)的(de)超法(fa)(fa)定(ding)(ding)(ding)(ding)(ding)退(tui)(tui)(tui)休(xiu)年齡的(de)勞(lao)動(dong)(dong)者(zhe),在工(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)間、工(gong)(gong)(gong)(gong)作(zuo)(zuo)地點因(yin)(yin)工(gong)(gong)(gong)(gong)作(zuo)(zuo)原因(yin)(yin)發生事(shi)故(gu)也可(ke)以認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)為工(gong)(gong)(gong)(gong)傷(shang)(shang)。
